EB-5 Application Process

Step 2: Prepare Form I-526 and submit it to USCIS

Once your Form I-526 is filed with USCIS, the process will move forward according to your location: applicants outside the U.S. will complete consular processing and an interview, while those already in the U.S. will proceed with an adjustment of status, including work authorization and travel permission.
Step 3: Petition Approved
Once your I-526 petition is approved by USCIS, you move one step closer to obtaining your U.S. permanent residency. At this stage, your case will proceed either through consular processing if you are abroad, or adjustment of status if you are already in the United States, paving the way for your conditional Green Card.
Step 4: Receive your Green Card
At this stage, you will receive a conditional Green Card valid for two years. This status grants you and your family the same rights and benefits as permanent residents, including the ability to live, work, and study anywhere in the U.S. The two-year period allows the U.S. government to confirm that your EB-5 investment remains in place and that the required job creation targets are being met.
Final Stage: File Form I-829
When the 2-year conditional Green Card period is nearing its expiration, the investor must file Form I-829 to confirm that all investment and job creation requirements have been met. Once approved, your status will be updated to a permanent Green Card, granting you full U.S. permanent residency
